Le bureau consulaire de l'Ambassade de la République de Cuba auprès du Royaume de Belgique et de la Mission auprès de l'Union européenne s'occupe des Cubains résidant en Belgique et offre des services consulaires aux personnes résidant dans ce pays.

L'Ambassade est ouverte du lundi au vendredi de 9h30 à 12h30, à l'exception des jours fériés cubains (1er et 2 janvier ; Vendredi saint ; 1er mai ; 25, 26 et 27 juillet ; 10 octobre ; 25 et 31 décembre).

Le paiement s'effectue par carte bancaire directement au bureau ou par virement bancaire.

Les services consulaires sont assurés par voie postale, mais la demande doit être envoyée un mois à l'avance. Les enveloppes contenant de l'argent liquide ne sont pas acceptées.

Aucune vaccination n'est requise ou recommandée pour se rendre à Cuba.

S'il s'agit d'un voyage touristique, il est obligatoire d'avoir une assurance médicale pour les jours de séjour à Cuba.

Inscription au registre consulaire :

Tous les citoyens cubains qui sollicitent un service dans un consulat cubain à l'étranger (à l'exception de ceux qui effectuent un voyage à l'étranger d'une durée maximale de 24 mois) doivent être inscrits au registre consulaire.

La demande d'inscription doit être effectuée directement auprès du consulat.

Vous devez présenter le formulaire correspondant avec toutes les informations remplies, une photocopie de votre passeport et deux photos. Cette procédure est personnelle, cependant, dans des cas exceptionnels, le service peut être effectué par courrier et pour cela vous devez envoyer une enveloppe timbrée et adressée avec votre carte d'inscription consulaire, que vous devez présenter pour demander n'importe quel service au consulat.

Vous devez payer la taxe consulaire pour ce service.

REMARQUE : Si la demande est faite par courrier ou par l'intermédiaire d'un tiers, c'est-à-dire si le citoyen cubain ne se présente pas physiquement au consulat, la taxe de traitement non personnel prévue à cet effet sera facturée en sus.

Tous les paiements doivent être effectués par carte de crédit ou par virement bancaire. Les espèces envoyées par la poste seront rejetées et renvoyées aux risques du demandeur.

Renouvellement de passeport :

Pour renouveler ou faire un nouveau passeport, vous avez besoin de :

une photocopie de votre passeport périmé (10 ans) et de votre passeport.
Deux photos d'identité en couleur de haute résolution, sur fond clair, de face, visage et tête découverts et sans lunettes noires.
Photocopie de votre carte consulaire (si vous faites votre demande par courrier).
Remplir le formulaire ci-joint comme indiqué à l'encre noire et en caractères d'imprimerie.
Vous devez payer la taxe consulaire prévue pour ce service.

En cas de perte du passeport, outre les conditions requises (de 2 à 5), vous devez présenter une déclaration de perte délivrée par la police du lieu où la perte s'est produite et une photocopie du passeport perdu. Si vous ne l'avez pas, vous devez présenter un acte de naissance ou une autre pièce d'identité confirmant la citoyenneté cubaine.

Si la procédure se fait par courrier, vous devez effectuer un virement bancaire sur le compte du consulat à l'avance et envoyer une enveloppe avec suffisamment de timbres pour renvoyer vos documents par courrier recommandé. Les paiements en espèces par la poste ne sont pas acceptés.
Si vous devez utiliser votre passeport rapidement au cours des prochains mois, vous devez demander un nouveau passeport deux mois à l'avance. Toutefois, vous pouvez demander un nouveau passeport 6 mois avant la date d'expiration.

- Ce formulaire ne sera pas valable s'il comporte des modifications, des ratures, des effacements ou des données incomplètes.

Vous devez remplir toutes les informations demandées et si vous ne remplissez pas toutes les informations ou aucune des informations demandées, remplissez-les avec un tiret, si vous laissez une information incomplète, elle sera considérée comme implicite : aucune.

Document d'identité et de voyage :

Le document d'identité et de voyage remplace le passeport cubain lorsque celui-ci a été perdu, égaré, volé ou a expiré et que vous devez vous rendre à Cuba de toute urgence, en présentant les documents qui le justifient. Ce document est autorisé par les autorités cubaines de l'immigration. Il n'est utilisé que pour entrer à Cuba.

Pour obtenir un document d'identité et de voyage, vous devez présenter

Un rapport de police s'il s'agit d'une perte de passeport.
Une photocopie du passeport perdu et du billet d'avion.
Une photo d'identité en couleur.
Une référence à la condition migratoire que vous avez (résidence à l'étranger, voyage temporaire, émigré).

Vous devez payer la taxe consulaire prévue pour ce service par un moyen de paiement certifié, en espèces ou par virement bancaire, et si vous faites la demande par la poste, vous devez joindre une enveloppe timbrée pour vous renvoyer le document.

ATTENTION : Les enfants de citoyens cubains résidant à l'étranger, auxquels les autorités migratoires du pays où ils vivent ne délivrent pas de document d'identité, en raison de sa législation interne, et dont les parents souhaitent qu'ils obtiennent la nationalité cubaine, doivent s'adresser au consulat cubain pour obtenir des informations sur cette procédure.

Prolongation du séjour à l'étranger pour plus de 24 mois :

Les citoyens cubains qui, pour une raison justifiée, ne peuvent pas retourner à Cuba dans le délai de 24 mois et souhaitent maintenir la condition migratoire du voyage temporaire, peuvent demander une prolongation de plus de 24 mois auprès du consulat cubain.

Pour faire cette demande, l'intéressé doit

Présenter un passeport cubain en cours de validité.
Présenter une demande écrite expliquant les raisons de la demande.
Présenter les documents justifiant les raisons de la demande (le cas échéant).
S'acquitter de la taxe consulaire prévue pour ce service.
Lorsqu'il reçoit l'information autorisant la prolongation de plus de 24 mois, l'intéressé doit payer la taxe consulaire pour chaque mois de prolongation autorisé.

Résidence à l'étranger (RE)

Demande de résidence à l'étranger (RE)
En général, la condition migratoire de résident à l'étranger est accordée aux citoyens cubains ayant des unions matrimoniales (formalisées ou non) avec des citoyens d'autres pays, qui vivent en dehors de l'île. Elle est également accordée aux parents et aux enfants de moins de 18 ans ou incapables, de citoyens cubains qui ont le statut migratoire de RE. Elle est également accordée aux parents proches sur le territoire national qui vivent avec des citoyens cubains ayant le statut migratoire d'ER, lorsqu'il est démontré qu'ils perdent une partie de leur protection ou qu'ils sont dans l'incapacité de travailler. Lorsqu'il existe d'autres raisons humanitaires ou familiales qui justifient la résidence à l'étranger de la personne concernée. Ce processus est autorisé par les autorités migratoires cubaines.

Les étapes suivantes doivent être suivies pour demander le SR :
I. Transcription et formalisation au Consulat du mariage célébré devant les autorités du pays étranger. Si vous n'avez pas encore effectué cette transcription, vous devez demander la documentation correspondante au consulat.
II. demande de résidence à l'étranger. Le conjoint cubain doit effectuer les démarches suivantes auprès du consulat :

Remplir les formulaires de demande de RE.

Quatre photos d'identité (4,5 x 4,5 cm).
Présenter une lettre de demande de RE adressée à la direction de l'identification, de l'immigration et des étrangers de Cuba.
Photocopie du passeport.
Photocopie du document de résidence du pays où vous résidez.
Nom, prénom et adresse de la personne de référence à Cuba (père, mère, frères et sœurs, etc.).
Si vous n'avez pas de passeport, une photocopie de votre acte de naissance.
Vous devez payer la taxe consulaire pour la demande. En cas d'approbation, au moment de la réception de la réponse des autorités cubaines compétentes, vous devez payer la taxe consulaire correspondant à l'octroi.
Si vous vous êtes marié à Cuba, vous devez présenter l'original du certificat de mariage datant de moins d'un an.

Si la demande est faite pour un mineur, l'original de l'acte de naissance du mineur doit être joint.
Le consulat enverra les documents susmentionnés à la direction cubaine de l'immigration et des affaires étrangères.
Le fait de demander le changement de statut de voyage n'implique pas qu'il soit automatiquement accordé, il peut être refusé ou accepté.
Une fois que le demandeur a obtenu l'ER (le consulat le lui a notifié), il peut entrer et sortir de Cuba quand il le souhaite et rester sur le territoire national jusqu'à 12 mois sans perdre son statut de résident à l'étranger.

Les obligations sont les suivantes :

S'inscrire au registre des citoyens cubains auprès du bureau consulaire correspondant au lieu de résidence.
Si vous transférez votre résidence dans un autre pays, vous devez en informer le bureau consulaire où vous êtes inscrit et vous devez également vous rendre au bureau consulaire le plus proche de votre nouvelle adresse pour vous réinscrire.
Si vous restez plus de 12 mois ininterrompus à Cuba, vous perdrez votre statut et devrez demander une nouvelle autorisation.
Le non-respect de l'une des obligations peut entraîner la révocation de l'EN.
Le non-respect de l'une des exigences relatives à l'octroi de l'autorisation peut entraîner la révocation de l'EN.

Les facilités offertes par cette condition sont les suivantes :

Vous pouvez visiter notre pays quand vous le souhaitez sans avoir à obtenir d'autorisation.
Lors de chaque voyage à Cuba, vous pouvez séjourner pendant une période de 6 mois sans avoir à accomplir de formalités et, si nécessaire, vous pouvez prolonger votre séjour jusqu'à un maximum de 12 mois, ce que vous devez faire auprès des autorités d'immigration correspondantes. En cas de séjour ininterrompu de plus d'un an à Cuba, vous devez informer les autorités de l'immigration et des étrangers de votre intention de maintenir votre résidence à l'étranger.
Les membres étrangers de la famille qui vous accompagnent dans votre voyage bénéficient d'un visa A-2 auprès du bureau consulaire pour une durée de 90 jours et peuvent, en cas de besoin, prolonger leur séjour dans le pays, sur demande auprès des autorités correspondantes de l'immigration.
Ils ont le droit de conserver leurs biens à Cuba.
Ils ont le droit d'hériter des biens de leurs proches parents.

Solicitud de residencia en el territorio nacional (HE-4)

Se otorga, por las autoridades migratorias cubanas, para entrar al territorio nacional a ciudadanos cubanos emigrados que desean reasentarse nuevamente en Cuba con carácter permanente. Las solicitudes serán formuladas en las oficinas consulares por los interesados. El expediente de solicitud de residencia en el territorio nacional se conforma con los documentos siguientes:

a) Presentar la planilla de solicitud.

b) Presentar Pasaporte cubano vigente.

c) Informar la persona de referencia que en Cuba se compromete a garantizar su alojamiento y manutención cuando corresponda hasta tanto el interesado pueda disponer de vivienda e ingresos propios. Esta voluntad deberá manifestarse mediante documento notarial en Cuba, por parte de la referencia, cuando Inmigración lo cite para tales efectos.

d) Pagar el arancel consular, según corresponda, de acuerdo con la legislación vigente.

El proceso de repatriación es tramitado por las autoridades migratorias cubanas, por lo que en caso de que se requiera, el solicitante deberá presentar cualquier otro documento que sea solicitado por las autoridades competentes. El consulado se encargará de notificar lo anterior al solicitante.

En el caso de los menores que deseen repatriarse sin uno o ambos padres deberá presentar un poder (documento notarial) a favor de la persona que asumirá la custodia del menor, otorgado por el padre o de los padres que no se acojan al proceso de repatriación.

Matrimonio en el exterior:

Para contraer matrimonio en el exterior el ciudadano cubano deberá presentar:

I. Para una persona soltera:

Certificación de nacimiento
Certificación de soltería expedida por la alcaldía o realizada ante un notario. El documento debe tener menos de seis meses de expedido.

II. Para una persona divorciada:

Certificación de nacimiento
Sentencia firme de divorcio

III. Para una persona viuda:

Certificación de nacimiento
Certificación de matrimonio
Certificación de defunción del cónyuge

Estos documentos deben estar legalizados por el Ministerio de Relaciones Exteriores de Cuba y la Embajada del país en La Habana.

En los países que así lo requieran, con los anteriores documentos, el Consulado confecciona un Certificado de ser exigido por las autoridades extranjeras, para la formalización del matrimonio y debe abonar el arancel consular estipulado para este servicio.

Matrimonio en Cuba:

Los matrimonios entre ciudadanos extranjeros o entre ciudadanos cubanos con ciudadanos extranjeros se realizan en las Consultorías Jurídicas Internacionales y Bufetes Internacionales. Los ciudadanos extranjeros deben presentar los siguientes documentos.

I. Para una persona soltera:

Certificación de nacimiento
Certificación de soltería expedida por la alcaldía o realizada ante un notario. El documento debe tener menos de seis meses de expedido.

II. Para una persona divorciada:

Certificación de nacimiento
Sentencia firme de divorcio

III. Para una persona viuda:

Certificación de nacimiento
Certificación de matrimonio
Certificación de defunción del cónyuge

Los documentos deben estar traducidos por un traductor jurado y legalizados, tanto el original, como la traducción, por las autoridades competentes. Posteriormente debe ser legalizado por el Consulado de Cuba o de lo contrario legalizar sólo el original por las autoridades competentes y luego realizar la traducción en el Consulado de Cuba, la cual debe ser igualmente legalizada

Debe abonar el arancel consular estipulado para este servicio.

NOTA: Si la solicitud se realiza por correos o a través de una tercera persona, se cobrará en adición, el arancel consular estipulado para este servicio.

Transcripción del matrimonio en el registro civil de Cuba

Después de realizado el matrimonio ante las autoridades del país, dicho acto se debe transcribir en el Consulado cubano correspondiente, para su reconocimiento final en Cuba.

A tales efectos, son imprescindibles los siguientes documentos:

Fotocopia de la certificación de nacimiento de ambos cónyuges.
Acta integral de matrimonio original, certificado y legalizado por las autoridades competentes del país.
Modelo de solicitud de transcripción de matrimonio, debidamente llenado.
Fotocopia del carné consular del ciudadano cubano.

Debe abonar el arancel consular estipulado para este servicio a través de tarjeta o transferencia bancaria. Los servicios que se cobran son: la legalización ante el Consulado de la certificación de matrimonio extranjera, la traducción y legalización de esta de esta, en caso que hiciera falta y todos los trámites de transcripción y registro. Este trámite se realiza siempre de forma personal.

Divorcio:
El reconocimiento en Cuba de una sentencia de divorcio firme, dictada por un tribunal extranjero, contra la que no quepa apelación ni recurso alguno, se hace a través del procedimiento Registral, es decir por medio de la Nota Marginal.

El Código de Familia en su Artículo 64 prevé la posibilidad de reconocimiento registral de una sentencia de divorcio dictada por tribunal extranjero, es decir, que la sentencia de divorcio dictada por un tribunal extranjero de un matrimonio celebrado en Cuba o celebrado en el extranjero y legalizado en el consulado cubano, puede ser reconocida registralmente. Para su tramitación se seguirán las siguientes indicaciones:

Procedimiento para la tramitación de un Divorcio Registral

El ciudadano cubanodeberá presentar la sentencia de divorcio en el consulado cubano en el país donde se materializó este acto. Se deberá legalizar y certificar dicha sentencia en el consulado, teniendo en cuenta que solo será sometida a trámite de asiento registral en Cuba, cuando contra ella no quepa recurso alguno, es decir, que sea una sentencia firme y definitiva.
En caso que la sentencia de divorcio fuere dictada en idioma extranjero, se deberá presentar la traducción integral al idioma español del documento. No se admitirán para este trámite traducciones parciales, ni resúmenes de tipo alguno. La traducción también será legalizada por la cancillería extranjera y el consulado.
El ciudadano cubano deberá presentarademás, el certificado de matrimonio cubano al que se refiere dicha sentencia de divorcio, pues es la única referencia que permite hacer llegar a aquella Certificación de Matrimonio, la Sentencia de Divorcio que será reflejada en nota marginal

Este trámite tiene un tiempo de duración de tres meses para concluir el proceso.

NOTA: Si la solicitud se realiza por correos o a través de una tercera persona, se cobrará en adición, el arancel consular estipulado para este servicio.

Todo pago debe realizarse por tarjeta o transferencia bancaria. El efectivo enviado por correo será rechazado y devuelto a riesgo del solicitante.

Procedimiento para la tramitación de un Divorcio Judicial

Cuando el proceso de divorcio se desea hacer bajo los requerimientos de la ley cubana:

Los cónyuges (o uno de ellos) deberán solicitar de forma individual un Poder Especial para divorcio, ante el funcionario consular. Debe abonar el arancel consular estipulado para este servicio.

Cuando sólo uno de los cónyuges realiza la solicitud de divorcio, este debe proporcionar la dirección del otro. De no conocer el domicilio de su cónyuge deberá realizar una declaración al respecto.

Documentos a entregar o llenar en el Consulado en el momento de la solicitud:

Certificación de matrimonio expedida por las autoridades cubanas.
Certificación de nacimiento de los hijos frutos del matrimonio. Si nacieron en el exterior debe ser legalizada por las autoridades del país extranjero y por nuestro Consulado.
Realizar un acta de comparecencia en el Consulado. Debe abonar el arancel consular estipulado para este servicio
Deberán presentarse no menos de 2 testigos, quienes harán una declaración individual. Debe abonar el arancel consular estipulado para este servicio
Carné de inscripción consular.

Debe abonar el arancel consular estipulado para la tramitación del expediente de divorcio judicial.

Poder General:

Debe abonar el arancel consular estipulado para este servicio.

Para este trámite usted debe especificar DETALLADAMENTE los motivos por los que usted desea ser representado por su apoderado.

Escritura de autorización para la confección de pasaporte y/o viaje al exterior por parte de los padres o representantes legales de los menores de 18 años o incapacitados:

Este trámite es personal.
El artículo 23 del Decreto Ley 305, establece el requisito de aportar la autorización formalizada ante Notario Público de los padres o los representantes legales que correspondan, de los menores de 18 años de edad o incapaces en el momento de la solicitud de confección de pasaporte.
Dicha autorización se exigirá por una sola vez, manteniendo su validez, siempre que la misma no haya sido revocada.
Esta autorización puede realizarse ante el funcionario consular para ello debe presentar:
Certificado de nacimiento del menor emitido por registro del estado civil de Cuba.
Pasaporte cubano del padre (cuando este es ciudadano cubano) o Documento de identidad permanente del padre (cuando este no sea ciudadano cubano)
En el caso de que los padres presenten una autorización emitida ante notario del país, la cual debe cumplir con las formalidades establecidas, esta debe ser legalizada por la oficina consular, aplicando el arancel correspondiente.
Los padres pueden también presentar una autorización emitida ante un notario en Cuba, siempre que la misma esté legalizada por el MINREX.
Podrán confeccionarse o aceptarse documentos que consignen la autorización de ambos padres en un mismo documento. No podrán confeccionarse o aceptarse en un mismo documento autorizaciones para más de un menor.

Transcripción de Nacimiento:

La transcripción de nacimiento se realiza a aquellas personas nacidas en el exterior, hijos de ciudadanos cubanos. La realización de este acto no implica la obtención automática de la ciudadanía cubana, ya que esta se obtiene previo cumplimiento de lo establecido en la Ley de ciudadanía del año 1944.
Para la solicitud debe presentar:

Modelo de Solicitud de Transcripción de Nacimiento completa.
Certificación de nacimiento original, expedida por las autoridades del país debidamente legalizada por las autoridades competentes del país.
Fotocopia del pasaporte del ciudadano cubano de la madre o del padre.
Carné de inscripción consular del padre o la madre cubana.
Se debe abonar el arancel consular estipulado para este servicio, por la legalización y traducción de la certificación de nacimiento y demás trámites necesarios.

Transcripción de defunción:

Cuando se produzca el fallecimiento de un ciudadano cubano en otro país, se debe transcribir en el consulado cubano, para su posterior registro en Cuba. Se deberán cumplimentar los requisitos siguientes:

Rellenar con letra clara y legible formulario de solicitud de transcripción de defunción, el que será entregado por el consulado y firmado por el familiar o por la persona jurídica y natural con capacidad legal para ello, y además la firma del funcionario consular.
Presentar Certificado de Defunción expedido por el registro civil del país en que ocurrió el fallecimiento, y para el caso de que fuese en idioma extranjero, debe estar traducido al español, certificado y legalizado por las autoridades competentes. Además certificado y legalizado por el funcionario consular cubano.
El acto de transcripción se exime de pago de aranceles, no así las legalizaciones que requieren los documentos, por las que debe abonar el arancel estipulado para este servicio.

Legalización y certificación de Documentos

Los documentos extranjeros que serán utilizados en Cuba para trámites legales deben estar legalizados y certificados por las autoridades correspondientes en el país.
Los documentos deben estar traducidos por un traductor jurado y legalizado, el original y la traducción, por las autoridades competentes y después por el Consulado de Cuba o de lo contrario legalizar sólo el original por las autoridades competentes y luego realizar la traducción en el Consulado de Cuba al igual que la legalización del original y de la traducción.

Traslado de cadáveres a Cuba / Traslado de cenizas a Cuba:

Cuando se desee trasladar el cadáver o las cenizas de un ciudadano cubano fallecido en el exterior hacia Cuba, aconsejamos que los familiares se comuniquen directamente con el Consulado de Cuba más cercano, quien le informará los trámites y diligencias a seguir para estos casos.

Visa de turismo (tarjeta turística):

La visa de turismo o tarjeta turística se utiliza solamente para viajes de ciudadanos extranjeros que desean hacer de turismo a Cuba. Válida para una sola entrada al territorio nacional en un viaje de 90 días y puede prorrogar 90 días más en el buró del hotel donde se hospeda o ante las autoridades de inmigración.
Los menores de edad deben tener su tarjeta de turismo aun cuando estén registrados en los pasaportes de los padres.

Solicitud de residencia en Cuba

Las solicitudes de RESIDENTES PERMANENTES serán formuladas por los extranjeros interesados, en los consulados, a lo que acompañarán:

Resultados de los exámenes radiográficos del tórax, serológicos y prueba del SIDA debidamente legalizados. (Los exámenes no pueden tener más de seis meses de emitidos antes de ser presentados en el Consulado. El examen de serología es único y es el mismo que nos hacemos en nuestro país. Estos exámenes pudieran ser presentados directamente en Cuba, siempre que se realicen en los hospitales o clínicas destinadas a la atención de los extranjeros en Cuba)
Certificación de Antecedentes penales en el país de residencia, debidamente legalizados. Al presentarlo al Consulado, no puede tener más de 3 meses de expedido por la institución oficial.

Consular registration:

All Cuban citizens travelling abroad who requests a service from any Cuban consulate abroad (except for those Travelling Abroad up to 24 months), should be registered in the consular register.

They should request the registration, directly in the consulate.

They should present the corresponding form with all the data filled out, the photocopy of his/her passport and two photos. This step is personal, nonetheless, in exceptional cases the service can be provided via e-mail and for that an envelope with stamps must be sent and the address for receiving the consular registration card, which must be presented to request any service in the Consulate. The consular fee stipulated for this service must be paid.

NOTE: If the application is made via e-mail or through a third person, if the Cuban citizen does not appear in person at the consulate, the non-personal tariff rate established in such cases will be charged additionally.

Only cash payment will be accepted, by means of a clearance certificate or bank transfer. The cash sent via e-mail will be returned at the risk of the applicant.

Passport Renewal:

In order to renew or issue a new passport is needed:

Photocopy of your expired passport (6 years) and the passport.
Two high resolution passport color photos with light background, front, with face and head bare and without dark glasses.
Photocopy of your consular registration card (if via e-mail).
Fill out attached form as indicated in black ink in capitals.
The stipulated consular fee for this service must be paid.

In the case of a lost passport, in addition to the requirements (from 2 to 5) a loss form issued by the police of the locality where the loss took place must be presented alongside the photocopy of the lost passport, if he/she does not have it, a birth certificate or another identification confirming the Cuban citizenship must be presented.

If the procedure is via e-mail a bank transfer must be sent in advance to the consulate account, and an envelope with enough stamps to return the documents via mail. Cash payments via e-mail will not be accepted.
If you are urged to use the passport in the next few months, a new passport should be requested two months in advance. Nonetheless you can request a new passport six months ahead of the expiry date.

Identity and travel document:

The identity and travel document replaces the Cuban passport when the latter is lost, stolen, or expired and you are urged to travel to Cuba, presenting the papers justifying this. This document is authorized by Cuban migration authorities. It is only used to enter Cuba.
For the issuing of an Identity Document you should present:

Extension to stay abroad for over 24 months:

The Cuban citizens who are unable to return to Cuba for some justified reason in a 24-month period and want to keep the migration status of temporary travel, may request the extension for over 24 months in the Cuban Consulate.

For this application the interested party must:

When the authorization of extension for over a 24-month period is informed, the interested party must pay the consular tariff rate, for every month of authorized extension.

Residence abroad

Application for Residence Abroad

Generally the migration status of the Resident Abroad is granted for Cuban citizens with marital unions (formalized or not) with citizens of other countries, living abroad. Also the parents and children under 18 years of age or disabled, of Cuban citizens with the RE migration status. Also for close relatives in the national territory living with RE Cuban citizen, when it is evident that they have lost part of their protection or are unfit for work. When there are other reasons being humanitarian or family supporting the resident status of the interested person abroad. This process is authorized by Cuban migration authorities. For requesting the RE the following steps are required:

I. Transcription and formalization at the Consulate of the marriage held before the authorities of the foreign country. If the transcription has not been made, the corresponding documents should requested from the Consulate.

II. Application for Residence Abroad. The Cuban spouse should carry out the procedures indicated below:

Four passport photographs (4,5 x 4,5) cm
Presenting a RE application form at the Cuban Immigration Office
Photocopy of your passport
Photocopy of the document from your country of residence
Name, Last names and address of the person of reference in Cuba (father, mother, siblings, etc.)
If you don’t have a passport, photocopy of your Birth Certificate.
You must pay the consular fees for the application. If it is approved, you must pay the corresponding consular fee for the approval at the moment of receiving the response from the Cuban authorities.
If you got married in Cuba, you should present the original Marriage Certificate with at least one year of being issued.

If this application is for an underage the original Birth Certificate must be attached.

The Consulate will send the aforesaid document to the Cuban Immigration Office.
The fact of having requested the change of travel status does not mean it is given automatically, it can be denied or granted.

Once the applicant is given the RE (the consulate will inform you) he/she can leave and return to Cuba whenever he/she wants and stay in the national territory up to 12 months without losing his/her Resident Abroad status.

Duties are:

Getting registered in the office for Cuban citizens of the Consular office of the corresponding place of residence.
If you moved your residence abroad you should notify the Consular Office where you are registered and you should appear at the nearest Consular Office of your new domicile to carry out the new registration.
If you will stay in Cuba for over 12 months you will lose status and should request a new authorization.
The failure to comply with these duties can result in the revocation of RE.
The non-permanence of some of the requirements demanded can result in the revocation of RE.

The opportunities offered by this status are:

Visit our country at will without previous authorization.
In every trip to Cuba you will be allowed to stay for a 6 month- period without the need for any kind of procedures and will extend the stay for at most 12 months if needed, which must be dealt with by the corresponding migration authorities. If you need to stay in Cuba for over a year, you should inform the immigration authorities about your intentions of keeping residence abroad.
The foreign relatives accompanying you on your travel are given an A-2 visa for 90 days and may extend their stay in the country if needed, by request to the corresponding migration authorities.
They can keep their properties in Cuba.
They can inherit goods from close relatives

Passport Authorization:

The authorization of multiple entry passport allows the entry to Cuba at will without additional procedure to its application. This allows Cuban immigrants to stay in Cuba for 90 days, a stay which can be exceptionally extended, requesting it directly from the Cuban Immigration Office in the nearest place of residence of his/her family in Cuba.

The authorization is not conceived for RE holders.

The authorization is a one-off procedure. When approved the authorization is valid indefinitely unless it is revoked. The application is made at the Cuban Consulate where you got registered, which will be in contact with the Cuban immigration service for its approval or rejection. You should fill out the consular form with this aim.

In order to travel to Cuba the authorization must be embossed on the Cuban citizen’s passport. Although it is approved, the authorization must be on the passport for the entry.

The Cuban émigrés who left the country prior to 1971 can travel to Cuba with foreign passport making the application at the consular office of a single door room called HE-11.

In order to enter Cuba, the Cuban émigré should present an accreditation document of residence in a foreign country together with the authorization.
In case of a denied authorization, his/her family in Cuba can make the application for entry authorization (HE-11) which is given under humanitarian reasons (serious illness or death of close relatives). This entry can only be requested in Cuba before the immigration authorities and is applied for by the Cuban citizen’s relatives.

Application for residence in the national territory (HE-4)

It is approved by the Cuban immigration authorities, for the entry in the national territory of Cuban émigrés who want to reinstate in Cuba permanently. The applications will be submitted in the consular offices by the interested parties. The application file for residence in the national territory is made up with the following documents:
A)   Present the application form
B)   Present the valid Cuban passport
C)   Notify the person of reference that he or she is responsible for securing accommodation and support in Cuba when needed until the interested party can have his/her own home and income. This will must be expressed through the notarial deed in Cuba, by the reference when immigration summoned him/her for such purposes.
D)   Pay the consular fee, as applicable, in accordance with current legislation.
The repatriation process is carried out by the Cuban immigration authorities, so that if required, the applicant must submit any other document that is requested by the competent authorities. The consulate will be in charge of notifying the abovementioned to the applicant.
In the case of children who wish to repatriate without one or both parents they must present a power of attorney (notary document) in favor of the person who will take custody of the child, granted by the parent or parents who do not accept the repatriation process.

Marriage abroad:

In order to marry abroad the Cuban citizen should present:
I. For a single person:

Birth Certificate
Single Status Certificate issued by the Mayor’s office or made before a notary. The document must be within six months of issue.

II. For a divorced person

III. For a widow or widower

Transcript of marriage in the civil registry of Cuba

After marriage by the authorities of the country, the act must be transcribed in the corresponding Cuban Consulate, for its final recognition in Cuba.
To these effects, the following documents are essential:

Photocopy of the birth certificate of both spouses.
Integral marriage certificate original, certified and legalized by the competent authorities of the country.
Model of request for transcription of marriage, duly filled in.
Photocopy of the consular card of the Cuban citizen.

Divorce:

The recognition in Cuba of a firm divorce decree, issued by a foreign court, against which no appeal or appeal can be made, is made through the Registrar procedure, that is to say through the Marginal Note.

Procedure for the processing of a Judicial Divorce

When the divorce process is to be done under the requirements of Cuban law:

Article 23 of Decree Law 305 establishes the requirement to provide the authorization formalized before a Notary Public of the parents or legal representatives that correspond, of the minors of 18 years of age or incapacitated at the time of the application for making a passport.

Birth Transcript:

The birth transcript is made for those born abroad, the children of Cuban citizens. The accomplishment of this act does not imply the automatic obtaining of the Cuban citizenship, since this is obtained with prior fulfillment of that established in the Citizenship Law of the year 1944.
For the application you must submit:

Complete Birth Transcript Application Form.
Original birth certificate, issued by the authorities of the country duly legalized by the competent authorities of the country.
Photocopy of the passport of the Cuban citizen of the mother or father.
Consular registration card of the Cuban father or mother.

Death Transcript:

When the death of a Cuban citizen in another country occurs, it must be transcribed in the Cuban consulate, for later registration in Cuba. The following requirements must be fulfilled:

Fill in a clear and legible letter of death transcript request form, which will be delivered by the consulate and signed by the relative or by the legal and natural person with legal capacity for it, and also the signature of the consular officer.
To present a Certificate of Death issued by the civil registry of the country where the death occurred, and in the case of a foreign language, must be translated into Spanish, certified and legalized by the competent authorities. Also certified and legalized by the Cuban consular official.
The act of transcription is exempt from payment of tariffs, but not the legalizations required for the documents, for which one must pay the stipulated tariff for this service.

Results of duly legalized radiographic examinations of the thorax, serological and AIDS tests. (The examinations cannot be more than six months since being issued before being presented at the Consulate.) The serology exam is unique and is the same one that we do in our country.
